What this tool is, what it is not, and the limits of every date on it.
These disclaimers govern your use of the Fall Foliage Tracker (the “Tool”), a free public service of More Than Just Parks, LLC (“More Than Just Parks,” “we,” “us”). They supplement, and are in addition to, our Terms of Service and Privacy Policy, which are incorporated here by reference. By using the Tool you acknowledge and agree to everything below. If you do not agree, do not use the Tool.
1. Informational purpose only
The Tool aggregates and presents third-party data about fall foliage timing, peak color forecasts, and related public lands conditions for general informational and trip-planning purposes only. It is not professional, legal, medical, safety, meteorological, or emergency-management advice, and it must not be relied upon as the sole basis for any travel, health, financial, or safety decision. Always independently verify conditions with the managing agency and local authorities before you act.
2. Not an emergency or safety system
This tool is not a travel, road, or weather safety system. It does not know whether a road is open, whether a park is closed, or what the weather will do. Check the managing agency and current conditions before you travel, and follow the instructions of land managers and emergency officials.
3. Third-party data and how it is produced
The Tool relies on data from government and third-party sources including, depending on the reading, the National Interagency Fire Center (NIFC/IRWIN), NASA FIRMS, the National Oceanic and Atmospheric Administration (NOAA HMS), the U.S. Environmental Protection Agency (EPA AirNow), PurpleAir, and the U.S. Geological Survey (USGS PAD-US). This data can be delayed, incomplete, inaccurate, unavailable, or wrong, and conditions on the ground change faster than any feed updates. We do not create, control, continuously monitor, or independently verify this data.
Every date on this tool is a FORECAST from a statistical model, not an observation. The model is fitted to forest monitoring stations and carries a measured confidence band that is stated beside every date; west of about 95 degrees longitude we hold almost no ground truth and the band is wide for that reason. Peak color also varies over short distances and elevations, so a forecast for a large national forest is not a forecast for one hillside inside it.
4. Automated analysis and AI
Some content, including verdicts, threat levels, plain-language summaries, and recommended alternatives, is generated or assisted by automated systems and artificial intelligence applied to the underlying data. Automated output may contain errors, omissions, or misclassifications and is provided without human review of every item. Treat it as a starting point, not a determination.
5. No affiliation or endorsement
More Than Just Parks is an independent organization. The Tool is not affiliated with, endorsed by, or sponsored by any government agency, and nothing in it constitutes an official government determination, warning, or closure. Agency names and data are referenced solely to identify sources.
6. Assumption of risk
Outdoor recreation on public lands carries inherent risks, including from fire, smoke, air quality, weather, terrain, and wildlife. You are solely responsible for evaluating conditions and your own fitness and preparation, and for any decision you make. By using the Tool you knowingly and voluntarily assume all risks associated with your use of it and your activities on public lands.
7. No warranties
THE TOOL AND ALL DATA, VERDICTS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORE THAN JUST PARKS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE TOOL WILL BE ACCURATE, RELIABLE, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORE THAN JUST PARKS AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, AND DATA PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE TOOL OR ANY DATA IN IT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE THE TOOL IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE TOOL WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING HERE LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
9. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless More Than Just Parks and its owners, members, officers, employees, and contributors from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Tool or your reliance on any data or verdict in it.
10. External links
The Tool may link to third-party sites and resources. We are not responsible for the content, accuracy, or availability of those sites, and a link is not an endorsement.
11. Changes
We may change, suspend, or discontinue the Tool, and update these disclaimers, at any time and without notice. Your continued use after a change means you accept it.
12. Governing law
These disclaimers and any dispute relating to the Tool are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction and venue there. If any provision is held unenforceable, the rest remains in effect.
