   BLM asks the board to set aside its own approval of the Townsite data center

   In a filing Monday, BLM attorney Kathryn Brinton asked the Interior Board of Land Appeals to set aside the agency’s decision approving the right-of-way amendment so it can conduct additional review of the application. The developer, Townsite Solar 2, supports the motion. The Center for Biological Diversity and the Sierra Club took no position. Boulder City opposes it, because a remand would lift the stay without committing BLM to an environmental assessment, public involvement or a cooperating-agency role for the city.

   Three weeks after the board found the challengers likely to win, the agency is asking to take back the first data center approval on BLM land rather than defend it. Whatever comes next at Townsite goes through the review the first approval skipped.

   Administrative Judge David Gunter stayed BLM’s authorization, finding the appellants likely to prevail on their NEPA claim and that the public interest in fast data center development does not outweigh the review the law requires. Construction is halted while the board hears the appeal.

   The first data center on public land is stopped, for now, by the process it skipped.

   Conservation groups and Boulder City residents appeal the Townsite approval

   The Center for Biological Diversity and the Sierra Club Toiyabe Chapter filed an administrative appeal at the Interior Board of Land Appeals, arguing BLM approved the data center without the site-specific environmental review the National Environmental Policy Act requires and without public comment.

   The appeal is the first legal test of a data center on public land.

   BLM approves the first data center on BLM land, 88.5 acres in Boulder City, Nevada

   The Bureau of Land Management approved construction of the Townsite Data Center on 88.5 acres of public land in Eldorado Valley, next to the Townsite Solar project, citing Executive Order 14318. The developer had pulled the same project from Boulder City’s own land process after residents objected.

   The first data center ever approved on BLM land, cleared without a new environmental review by treating it as a change to a solar right-of-way.
