Data and Legal Notice

What this tool is

The Data Center Tracker aggregates information about data center projects in the United States from third-party public sources, including industry publications, company announcements, local news, and government and utility filings. Each entry links to the source it’s based on. It’s a work of journalism, research, and commentary on a matter of public concern: the rapid buildout of data center infrastructure and its effect on communities, energy grids, water, and public lands. It’s published in the public interest and is intended as protected speech and commentary, not as a commercial representation about any company.

How to read an entry

Operator, location, capacity, and status for each project reflect that third-party reporting and our good-faith interpretation of it. They aren’t independent assertions of fact by More Than Just Parks, and they may be incomplete, provisional, or in error. Nothing here is a statement that any named company has made a specific filing, decision, or commitment except as reported by the linked source. Where a company is named, the association is drawn from the cited source, not confirmed by the company itself.

No warranty; not advice

Information is provided “as is,” without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose. Nothing here is legal, financial, investment, real-estate, or professional advice, and it shouldn’t be relied upon for any decision. More Than Just Parks isn’t liable for any loss or damage arising from use of this tool.

Trademarks and affiliation

Company names, product names, project names, and logos are trademarks or registered trademarks of their respective owners. They’re used here for identification, reference, and commentary only, under nominative fair use. More Than Just Parks isn’t affiliated with, authorized by, endorsed by, or sponsored by any company named on this tool, and no such association is implied.

Requesting a correction or retraction

We correct promptly and in good faith. If you’re a company, developer, landowner, or reader and believe an entry is inaccurate, incomplete, or should be removed, email ask@morethanjustparks.com. Identify the specific entry and what’s wrong, and we’ll review and, where warranted, correct or remove it, typically within a few business days.

If you believe any statement here is false and defamatory, write to that address and identify the specific statements you say are false and the basis for the correction. We review every request and update the record where the evidence warrants. Under Georgia law, a written request for correction or retraction made at least seven days before a libel action is filed is relevant to the damages available in that action (O.C.G.A. § 51-5-11), and we would rather fix a mistake than argue about one.

Governing law

More Than Just Parks is based in Georgia. This notice and any dispute arising from the Data Center Tracker are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules, and the state and federal courts located in Georgia are the exclusive venue for any such dispute.

This tool addresses matters of public interest and public concern. Georgia’s anti-SLAPP statute (O.C.G.A. § 9-11-11.1) provides for a motion to strike claims arising from acts in furtherance of free speech or petition rights in connection with an issue of public interest or concern, and we’ll invoke it where it applies. Nothing in this notice waives any privilege, immunity, or defense available to us under law.
